The applicant is proposing to subdivide a portion of the existing development site to temporarily create a lot for construction financing. The applicant is seeking variances from the Subdivision
By-Law to vary the requirement to provide Lands for Public Purpose (LPP) dedication, on the premise that the created lot will be amalgamated back into the parent parcel within two years and to create a lot that does not abut a public street.

The applicant has applied to subdivide a 0.57-hectare portion of the site from the parent parcel and rezone the portion being subdivided (Lot 24-1) to allow for the construction of a four-unit townhouse. The rezoning to Low-Rise Residential (RL) would allow for the construction of the proposed townhouse and the retention of the existing single unit dwelling that portion of the subject site.

The applicant is seeking an amendment to the Section 59 conditions imposed on the 2016 rezoning of the site. Construction of a drive-thru restaurant is proposed in the northwestern corner of the site adjacent to the University Avenue and Millidge Avenue intersection.

The proposal seeks to rezone predominantly developable portions of the subject property from Rural (RU) to Medium Industrial (IM), which requires a Municipal Plan amendment to        Heavy Industrial. The portion of the site designated as Park and Natural Areas in the Municipal Plan will be rezoned to Park (P) zone under the Zoning Bylaw. The subject property is being rezoned and redesignated in order to allow for future subdivisions and lot line adjustments with an adjacent parcel, and to meet future industrial demand driven by expanding business opportunities. An adjustment to the Primary Development Area (PDA) boundary is required to support the extension of municipal water and wastewater services to the subject site.

This application is to rezone the subject property to permit the development of a 10-unit residential building and to align the existing legal non-conforming 10-unit building to an appropriate residential zone.
